These erms and Conditions (TOS) apply to all contracts concluded between Key2Host and the customer for the provision of hosting services. Deviating agreements are only effective if they have been confirmed in writing by Key2Host.

The contract is concluded with the acceptance of the customer's order by Key2Host. The customer receives a confirmation by e-mail. All offers are subject to change and non-binding. Key2Host reserves the right to refuse orders without giving reasons.

Key2Host offers services such as the provision of cloud servers, dedicated servers, domain registrations and VPN services. The exact services can be found in the service description on the website. Key2Host is entitled to change or discontinue the services at any time, provided this is reasonable for the customer.

Key2Host strives for the highest possible availability of its services, but does not guarantee continuous availability. Maintenance work and unforeseen outages can lead to interruptions. However, Key2Host will try to announce planned maintenance work in good time and minimize the impact on operations.

All prices are quoted in euros and include VAT unless otherwise stated. Payments must be made in advance. Supported payment methods are indicated on the website. If the customer defaults on payment, Key2Host reserves the right to restrict or discontinue services. In the event of late payment, reminder fees and default interest will be charged in accordance with the statutory provisions.

The customer is obliged to keep his access data safe and secret. Key2Host is not liable for damages caused by unauthorized use of the account. The customer is obliged to inform Key2Host immediately of the loss or misuse of access data.

Key2Host is committed to protecting the personal data of customers in accordance with the General Data Protection Regulation (GDPR). Further information can be found in the privacy policy. The customer consents to the processing of their data insofar as this is necessary for the performance of the contract.

The customer guarantees that all content stored on or distributed via Key2Host's servers does not violate any copyrights or intellectual property rights of third parties. Key2Host reserves the right to remove content that violates applicable law or these TOS without prior notice.

Key2Host is only liable for intent and gross negligence. In the case of slight negligence, Key2Host is only liable for breaches of essential contractual obligations. Liability for loss of data or unforeseeable damage is excluded. Key2Host accepts no liability for server failures or other technical faults that are beyond its control.

Key2Host reserves the right to block a customer's account if there are indications of illegal activities, misuse or violations of these TOS. An account may also be blocked without prior notice if there is an acute threat to the security of systems or data.

The customer undertakes not to use the services of Key2Host for illegal, harmful or abusive activities. This includes, but is not limited to: Denial of Service (DoS) attacks, spreading malware, sending spam or hosting phishing sites. In the event of such abuse, Key2Host reserves the right to immediately block the customer's access and terminate the contract without refund.

The customer is expressly prohibited from using server resources for hosting cryptomining services, illegal software applications or other programs that violate applicable law or morality. This includes, in particular, applications that are used to mine cryptocurrencies or to carry out illegal activities. Violations of this provision will result in the immediate blocking of the account and termination of the contract without notice and without reimbursement of payments.

The dissemination of terrorist content or material that incites violence or the spread of hatred and intolerance is strictly prohibited. Key2Host will take all necessary measures immediately if such activities are suspected, including the immediate blocking of accounts and reporting to the relevant authorities.

Unless otherwise agreed, contracts can be terminated with 14 days' notice to the end of the term. The right to extraordinary termination remains unaffected. Key2Host reserves the right to terminate the contract without notice in the event of serious breaches of the TOS, e.g. misuse of services.

Should individual provisions of these Terms and Conditions be invalid or unenforceable in whole or in part, this shall not affect the validity of the remaining provisions. The invalid or unenforceable provision shall be replaced by a provision that comes closest to the economic purpose of the invalid provision. The same applies to any loopholes in these TOS.

The law of the Federal Republic of Germany shall apply. The place of jurisdiction is Ibbenbüren, provided the customer is a merchant. Should individual provisions be invalid, the validity of the remaining provisions shall remain unaffected. Key2Host reserves the right to change these TOS at any time, whereby the customer will be notified of the changes at least 14 days before they come into effect.
